Terms of Service

1. Introduction

Welcome to ChessFlare.com. By using our services, you fully and unreservedly accept these Terms of Service (ToS).

If you do not agree with these ToS, you must not use ChessFlare.com.

2. Definitions

• "We" / "ChessFlare": ANAKYOS, a French simplified joint-stock company (SAS), operator of the ChessFlare website and mobile applications.
• "User": any natural or legal person using ChessFlare.com.
• "Services": all features offered by ChessFlare.com (game import and analysis, annotations, Elo tracking, etc.).
• "Account": personal space created by the User.

3. Description of Services

ChessFlare notably allows Users to:

• import, store, and analyze chess games,
• annotate and comment on games,
• track performance (Elo rating, statistics),
• access premium features through a paid subscription.

We do our best to ensure continuous availability but cannot guarantee the absence of interruptions or bugs.

4. Account Creation

An account can be created via:

• Email + password,
• Google login (OAuth),
• Sign in with Apple, when available.

The User is responsible for keeping login credentials confidential and for the accuracy of the information provided.

5. Subscriptions and Payments

ChessFlare offers two auto-renewing plans:

• Monthly subscription,
• Annual subscription.

Web purchases.Eligible purchases made on the ChessFlare website are processed through Stripe Managed Payments. For those transactions, Sold through Link, LLC acts as merchant of record and handles checkout, payment collection, receipts, applicable indirect taxes (including VAT, GST or sales tax), fraud prevention, disputes and transaction support under its own terms. ANAKYOS remains responsible for providing and supporting the ChessFlare service.

Mobile purchases.Purchases made in the iOS or Android application are billed by the Apple App Store or Google Play. The applicable store controls payment, renewal, cancellation, receipts and refund handling under its own terms. RevenueCat is used only to validate purchase information, synchronise subscription status and unlock the corresponding entitlements; RevenueCat does not collect the User's payment card details.

Subscriptions renew automatically for the selected billing period until cancelled. The User must manage or cancel a subscription through the same platform used to purchase it (Stripe's customer interface, Apple App Store or Google Play). Cancellation normally takes effect at the end of the current paid period. Prices, applicable taxes and the renewal frequency are displayed before purchase.

Refunds, payment disputes and billing corrections are handled by the merchant of record or app store that processed the purchase, according to its procedures and applicable law. Nothing in these Terms limits mandatory consumer rights.

6. Right of Withdrawal

Where applicable law provides a right of withdrawal, the User may exercise it within the applicable period and under the applicable conditions. For digital content or services supplied immediately, the User may be asked at checkout to request immediate performance and, where legally permitted, expressly acknowledge the resulting loss of the right of withdrawal. Any waiver applies only when all mandatory legal conditions are satisfied.

For purchases processed by Stripe Managed Payments, Apple or Google, withdrawal and refund requests must also follow the procedure made available by the relevant provider, without prejudice to mandatory consumer rights.

7. User Obligations

The User agrees to:

• comply with applicable laws,
• not cheat or misuse the features,
• not bypass security measures,
• not share illegal, hateful, violent, sexual, or rights-infringing content,
• not disrupt the proper functioning of the service (spam, overload, malware).

Any violation may result in immediate suspension or deletion of the account, without refund.

8. Limitation of Liability

ChessFlare shall not be held liable for:

• interruptions or data loss,
• outages or delays attributable to Stripe, Apple, Google, RevenueCat or another third-party provider,
• indirect damages related to the use of the service,
• damages exceeding the amount paid by the User during the last 12 months.

Nothing excludes our liability in cases of gross negligence, death, or personal injury caused by our negligence.

9. Termination

The User may close their account at any time.
ChessFlare may suspend or delete an account in case of violation of these ToS or harmful behavior.

10. Personal Data

Using ChessFlare involves the collection and processing of data (email, username, Elo rating, games, annotations) in accordance with our Privacy Policy.

11. Modifications

ChessFlare may modify the ToS at any time. Users will be notified of changes (by email or on-site notification). Continued use of the service constitutes acceptance of the new terms.

12. Governing Law and Jurisdiction

These ToS are governed by French law.
The competent courts are determined by applicable law, without prejudice to mandatory consumer-protection rules.
